O.J.'s Vegas Caper: Can the Juice get squeezed for stealing his own stuff?

ARMED ROBBERY RULE:  Armed robbery is the taking of another’s property from his immediate possession by threat of force with a dangerous weapon with the intent to permanently deprive the owner of it.  This means if someone takes property directly from another person by threatening to use a dangerous weapon, (gun, knife, club, etc.) that person is guilty of an armed robbery.

AGGRAVATED ASSAULT RULE:  The threat of physical harm to another is an assault, when a dangerous weapon is added to the mix, the crime as an aggravated assault.

In this case O.J., an armed golf buddy, and some newly acquired pals decided to retrieve some memorabilia from his football career that was reported to be up for auction at a Las Vegas hotel.  O.J. claims the property belonged to him, and the items were “his private belongings.”  O.J. claims the property was actually stolen from his possession at an earlier date.  It is undisputed that O.J. was not in possession of a dangerous weapon, but his golfing buddy was.  His golfing buddy, “Alexander” also reportedly assaulted one of the victims.  O.J. is now being tried with 7 felonies spanning from assault with a deadly weapon and coercion to armed robbery with a deadly weapon.  If convicted “The Juice” could feel the squeeze for 3 to 35 years…

If it can be determined that the items in fact belonged to O.J. then he can possibly avoid the Armed Robbery charge, as well as the conspiracy charges related to it.  He will then still face civil charges related to the forcible taking, but may avoid criminal armed robbery charges. 

He will then have to deal with the assault charges.  O.J. may be able to argue that he had no knowledge of his friend’s weapon, and was not intending to commit any crime what-so-ever.  This would alleviate him from the conspiracy charges which would allow him to avoid being tried for an assault committed by his partner.

O.J. has a lot to prove in order to escape this one, but as many will tell you, history repeats itself.  Sit back and watch the latest turnouts in the O.J. Simpson saga…  What do you think should happen in this case, what do you think will happen?

TAKEAWAY:  If someone really does have your property it is probably best to ask for help from the authorities, not your ill tempered golfing buddy, to get it back.  At the very minimum don’t go slinging guns in attempt to get what is yours.

Most of us probably know somebody who has personal property that they would like to get back from somebody, what advice would you give to this person given the foresaid information?

Simpson will be eligible for parole after nine years. His co-defendant Clarence "C.J." Stewart was sentenced to at least 15 years behind bars."
